AI REGULATION AROUND THE WORLD: WHERE DOES INDIA STAND?

Artificial Intelligence (AI) is transforming economies, governments, and daily life at an unprecedented rate. From generative AI tools to surveillance systems, the need for comprehensive regulation has never been more urgent. While countries like the EU and U.S. have already made headway in AI governance, India finds itself at a crossroads—balancing innovation with ethical safeguards.

Global Overview: Who’s Leading in AI Regulation?

European Union (EU): The EU’s AI Act, passed in 2024, is the world’s first comprehensive AI law. It categorizes AI systems into risk-based tiers and sets strict standards for high-risk applications such as facial recognition and credit scoring.

DIGITAL ECONOMY POTENTIAL

United States: The U.S. approach is more decentralized. In 2025, draft legislation emphasizes transparency, data rights, and liability but largely depends on sector-specific regulation and corporate self-regulation.
China: China has implemented strict AI content regulation, especially for deepfakes and recommendation algorithms. Its regulatory focus aligns closely with national security and censorship priorities.

INDIA’S POSITION: A WORK IN PROGRESS

India, home to one of the world’s largest digital populations, has taken steps—but not yet enacted a full AI law. Current initiatives include:

  • Adopt Risk-Based Categorization: Follow the EU model to differentiate between low-risk (chatbots) and high-risk (healthcare AI) applications.
  • Mandatory Impact Assessments: Before deployment, high-risk AI systems should undergo algorithmic audits.
  • Citizen Rights Charter for AI: Guarantee rights like explanation of decisions, correction of AI errors, and appeal mechanisms.
